User Agreement

1. Subject Matter of the User Agreement

1.1. The Subject Matter of this User Agreement (“UA”) is the relationship between Mail.Ru LLC (OGRN (Primary State Registration Number) 1027739850962, 39 Leningradskiy prospect, building 79, Moscow, Russian Federation, 125167), hereinafter referred to as “Mail.Ru”, which is the copyright holder of Internet services (information, communication, advertising, educational, entertainment and other nature), located on the Internet at https://mail.ru/, as well as on other domains administered by Mail.Ru (hereinafter referred to as the “Internet services”, “Services”, “Website”), and by You (an individual user of the Internet), hereinafter referred to as the “User ”on the use and provision of the Services. By use of the Services, the User shall agree to comply with the terms and conditions described in this User Agreement. The use of certain Services may be governed by separate rules applicable to a specific Service (the “Service User Agreement”), which are also part of this UA.

1.2. The User Agreement shall regulate the use of all Services of Mail.Ru. The provisions of this User Agreement shall be mandatory for all Users who have registered through the Services or have begun to use any of the Services.The User may find out the current version of the UA by clicking on the following link: https://help.mail.ru/enmail-help/UA For each time accessing and/or actually using any of the Services the User accepts the terms and conditions of this User Agreement, as well as the terms and conditions of agreements, provisions and rules of the Services used by him/her that are posted on the pages (in the sections) of the respective Services as in effect at the time of actual use of such Services.

1.3. This document is a translation from the Russian language of the User Agreement which available at https://help.mail.ru/mail-help/UA. In case of any contradictions between this document and the User Agreement on the Russian language, the User Agreement on the Russian language will prevail.

2. General Terms and Conditions

2.1. Mail.Ru shall provide access to the Services through a personal computer, as well as mobile and other devices, both existing at present and those that will be developed in the future, taking into account the features of the Services.

2.2. The User understands and agrees that the Services of Mail.Ru may contain advertising, and that the presence of this advertising is a necessary condition for using the Services of Mail.Ru.

2.3. All Services of Mail.Ru, including the postal service, shall be provided “as is”. Mail.Ru shall not accept any responsibility for the delay, deletion, non-delivery or inability to load any User data, including the User settings, and shall not be responsible for the compliance of the postal service with the purposes of the User. All matters of granting access rights to the Internet, purchases and adjustments for this relevant equipment and software products shall be resolved by the User independently and shall not be subject to this User Agreement.

2.4. The free e-mail service of Mail.Ru (hereinafter referred to as the “Mail”) is a service that provides the creation and exchange of e-mails using the web interface located at: https://mail.ru/, and using the specialized hardware and software aimed at the transfer, accumulation and processing of correspondence of Users, presented in electronic form, providing the User with a unique Mail address of the following types: anysymbols@mail.ru, anysymbols@inbox.ru, anysymbols@bk.ru, anysymbols@list.ru, as well as Mail boxes (with the ability to store electronic messages of Users, incoming and outcoming from the selected e-mail addresses).

2.5. The User shall agree that Mail.Ru may collect anonymous statistical data about Users of Services of Mail.Ru.

2.6.  The User shall agree to receive via services of Mail.Ru and/or services of third parties e-mail, sms and other types of mailings of promotional and informational content, including from Mail.Ru partners, to which the User has agreed to send messages to it. 

2.6.1. As part of individual Services of Mail.Ru, the User may be provided with the functional ability to send SMS messages independently to third parties. By sending SMS messages to third parties via Services of Mail.Ru, the User shall agree that such sent SMS messages may be defined as sent from its phone number and on its behalf, and sent not from its phone number, but on its behalf. At the same time, the User shall be solely responsible for all possible claims related to sending SMS messages to such persons.

2.7. Mail.Ru shall have the right to set any additional requirements and restrictions with respect to registration on the Website and use of the Services.

2.8. In order to use the Internet service as a set of computer programs, Mail.Ru shall provide the User (Licensee) on the terms and conditions of a simple (non-exclusive) gratuitous license the right to use the free functional (software) features of the Internet service. The use of additional paid functional (software) features of the Internet service shall be provided by Mail.Ru to the User (Licensee) on the terms and conditions of a simple (non-exclusive) license for a period stipulated by the corresponding additional paid functional (software) features of the Internet service, by obtaining access to additional paid functional (software) features of the Internet service and its actual use within the territory where the Internet service is available. 

3. Entry into force of the User Agreement

3.1. This User Agreement, as well as amendments and additions to this User Agreement, shall enter into force upon their publication at https://help.mail.ru/enmail-help/UA. The User’s consent to the terms and conditions of the User Agreement shall be expressed in the form of the User clicking the “Register Mail box” button placed under the registration form of the electronic mail box, and under the registration form in any of the Services of Mail.Ru, or by actually using the Services of Mail.Ru.

3.2. The User shall have the right to refuse to accept amendments and additions to the UA made by Mail.Ru, which means that the User refuses to use the Services of Mail.Ru.

4. Obligations of the User to register under the Internet service

4.1 In order to use the Mail and Services of Mail.Ru, as well as to obtain the rights to use additional functional (software) features of the Internet service, the User must go through the following registration procedure:

4.1.1. Fill in the registration form in the Mail or on the Services of Mail.Ru. In the process of filling in the registration form, the User shall independently select the Login and Password required for the subsequent access to the electronic mail box, shall indicate the data required for registration, as well as information data, allowing the User to independently restore access to its electronic mail box.

The risk of fraudulent and other illegal actions with the User’s electronic mail box in connection with the loss of the Password shall be borne by the User. The User shall be recommended to choose a password of sufficient complexity to avoid the possibility of its selection by third parties.

4.1.2. At the same time, Mail.Ru shall not verify the information provided by the User in any way, hereinafter referred to as the credentials (unless otherwise provided by the terms and conditions of providing any particular Service), shall not be liable to any third parties for the accuracy and reliability of the credentials. 

The credentials and other data of the User are processed by Mail.Ru in order to properly execute this UA.

For the purpose of performance of this User Agreement and for granting access to the User to the functionality of the Services, Mail.Ru develops, improves, optimizes and implements new functionality of the Services (including services and products of informational, communication, advertising, educational, entertainment and other nature), including with the participation of affiliates and/or partners. In order to ensure achievement of the specified purposes the User agrees and instructs Mail.Ru to carry out, in compliance with the applicable legislation, processing (including collection, recording, systematization, accumulation, storage, refinement (updating, modification), comparison, retrieval, use, depersonalization, blocking, deletion and destruction) of the credentials and other data of the User, including results of automated processing of such data, and specifically in the form of whole-number and/or text values ​​and identifiers, their transfer to the affiliates and/or partners in pursuance of such instruction for processing, as well as to collect (receive) its credentials and other data from the affiliates and/or partners.

The credentials are information that the User provides on its own at the registration stage on the Services of Mail.Ru by filling in a registration form and some of the Services provided during use. Other data means data associated with the User, which becomes available to Mail.Ru in the process of the User using the Services of Mail.Ru and/or services of affiliates and/or partners. Such data may include information on technical means (devices) and methods of technological interaction with the Services of Mail.Ru and/or services of affiliates and/or partners (including the IP address of the host, type of the operating system of the User, browser type, geographical location, data about the provider and other), about the activity of the User, as well as other data obtained by these methods.

Mail.Ru may have access to other information relating to the User and left to the latter in its sole discretion in the process of using the Services, which is not processed by Mail.Ru, including to achieve the goals specified in this UA.

The processing of credentials and other data of the User shall be carried out during the entire period of time from the moment of the registration of the User and until the moment of deleting its account, unless otherwise stipulated by the functionality of the Services and/or provided for by the current legislation.

In order to properly perform the terms and conditions of this UA, Mail.Ru shall take measures to ensure the security of its Services. To achieve these goals, the User shall agree that credentials and other data may be transferred to third parties, including in cases provided for by applicable legislation, to the extent necessary to identify, investigate and prevent unlawful actions.

The User shall agree to reflect its credentials and other data, as well as other information in the User’s profile and other Services within the framework of the Services functionality, and that such data will be considered publicly available if the User shall not select a different mode of access within the Services functionality. The User shall agree that the information, including the credentials and other data, may be available to other Internet users subject to the existing Service functionality (as may be modified by Mail.Ru from time to time). Mail.Ru may limit the use of information from the Services by the third parties, including for commercial purposes. The use of Mail.Ru information shall be determined by this UA.

4.1.3. In addition to the procedure for registration on the Internet service specified in clause 4.1., the User may be granted the right to register by using the data (login and password) from an electronic mail box created by the User on the third party resource.

When using any of the methods of registering with the Internet service, the User’s password for accessing the Internet service for Mail.Ru is not available.

Any of these methods of registration allows the User, using the Mail Client Program, to create several accounts that belong to the corresponding electronic mail box. The conditions for using the Mail Client Program shall be contained in the License Agreement for the Mail Client Program, which is an integral part of this User Agreement and is posted on the corresponding page of the Website. Using the interface of the Internet service for registration using the login and password from the electronic mail box of a third party resource, as well as creating the corresponding account in the Mail Client Program, the User shall agree to the terms and conditions of this User Agreement and the License Agreement for the Mail Client Program.

4.2 The User shall personally be responsible for the safety and security of his/her Password and information data. 

4.2.1. Mail.Ru shall not be responsible and shall not guarantee the security of the User’s electronic mail box in the following cases: transmission to third parties (intentionally or through negligence) of the Password and information data; third party access to the User’s electronic mail box using software tools that allow for the selection and/or decoding of the Password; access of the third parties to the User’s electronic mail box by simple selection of the Password and information data; the User’s failure to comply with the recommendations specified in this User Agreement or the Service interface.

4.3 Mail.Ru is entitled to provide the User with the opportunity to transfer the credentials to the third parties by means of the special technologies (Open ID, etc.), subject to the User’s consent to such transfer. In this regard Mail.Ru shall not guarantee the User the completeness and correctness of the transfer of credentials and shall not be responsible for the safety of the data during the transfer.  

4.4 The User shall:

    • immediately notify Mail.Ru of any unauthorized use of its password or account by the User or any other security violation;
    • log out of his/her account (complete each session on the “Exit” button) after finishing work with his/her Mail and the personal part of the Services of Mail.Ru. Mail.Ru shall not be responsible for any data loss or damage that may occur due to non-compliance with the recommendations set out in section 4 of this User Agreement.

4.5 Access to the Mail and any Service of Mail.Ru may be restored to the User only in the case of accurate, proper and complete indication of the information specified during registration of the account. If the User has neglected the accurate, proper and complete indication of the registration information, Mail.Ru Support Service will not be able to recover the password upon request.

In case of loss of the password from the electronic mail box created on the third party resource used by the User along with the login to access the Internet service, such password may be recovered only in ways provided for by the third party resource.

In case of deleting the electronic mail box created by the User on the third party resource, or changing the password from him/her that he/she has used to access the Internet service, access to the Internet service shall be performed using the password that was used by the User during his/her last login to the Internet service.

Mail.Ru recommends to protect the password and fill in the registration form of the Mail and Services of Mail.Ru accurately, properly and completely.

5. Rules of Conduct for Registered Users

5.1 The User shall solely be responsible for the content of its mail messages, as well as for all information, data, text, programs, music, sounds, photos, graphics, videos, messages and other materials (hereinafter referred to as the “Materials”), publicly published and/or transferred via Services of Mail.Ru. This means that the User, rather than Mail.Ru, shall fully be responsible for all materials that the User downloads, sends, receives, transmits, or in any other way makes available through the Services of Mail.Ru. Mail.Ru shall not control the materials transmitted via Mail and other Services of Mail.Ru, therefore, shall not guarantee the accuracy, completeness or quality of these materials. The User understands that using some Services of Mail.Ru, he/she may see materials that may be regarded by him/her as offensive, inauthentic or controversial and the User understands that the User who posted them is responsible for the placement of such materials, and not Mail.Ru.

5.1.1 The User agrees that by downloading Materials to the Website, the User grants access to them for other registered Users by default. Mail.Ru is only a means to allow the User to access and post the Materials for general public.

5.2 The User agrees not to use the Services of Mail.Ru for:

5.2.1 downloading, sending, transmitting or any other method of publishing materials, including indicating to its location, by posting links that are illegal, harmful, threatening, offending morality, slanderous, violating copyright and other intellectual property rights that promote hatred and/or discrimination of people on racial, ethnic, gender, social grounds, as well as violating the accepted norms and ethics of communication on the Internet, or complicating the work of other Users with the Services of Mail.Ru; 

5.2.2 violation of the rights of minors and/or causing them harm in any form, including moral;

5.2.3 violation of the rights of various minorities;

5.2.4 impersonating another person or representative of the organization and/or the community, including Mail.Ru Support Service, Mail.Ru employees, forum moderators, as well as misleading;

5.2.5 downloading, sending, transmitting or any other way of publishing materials that the User is not entitled to make available under the law or under any agreements with third parties;

5.2.6 downloading, sending, transmitting or any other way of publishing materials that violate any rights of third parties, including the right to trademarks (service marks), trade secrets, and/or for violation any other intellectual property rights of third parties;

5.2.7 downloading, sending, transmitting or any other way of publishing advertising information that is not authorized by any special means, including mass, unauthorized and/or unexpected by recipients, unsolicited advertising mailings, including mailings, with a large number of repetitions at one postal address (“Spam”), as well as repeated sending of letters to one addressee, not agreed with him/her;

5.2.8 downloading, sending, transmitting or any other way of publishing any material containing viruses or other computer codes, files or programs intended to violate, destroy or limit the functionality of any computer or telecommunications equipment or programs for unauthorized access to computer systems, equipment or data of third parties, as well as serial numbers to commercial software products and programs for their generation, logins, passwords and other means for obtaining unauthorized access to paid resources on the Internet, as well as posting links to the above information;

5.2.9 violation of any norms of the current Russian and/or international legislation, as well as the legislation of foreign States;

5.2.10 collection and storage of personal data of third parties;

5.2.11 sending emails to someone’s address via the Mail, as well as posting text, photos and video materials containing rude, obscene or offensive expressions and sentences to the Services of Mail.Ru;

5.2.12 sending emails containing text, photo and video materials of a pornographic nature, as well as posting these materials in the Services of Mail.Ru;

5.2.13 disrupting the normal operation of the Internet service by using pop-up windows (“pop-up” windows);

5.2.14 posting links to Internet resources, the content of which contradicts the current legislation of the Russian Federation.

5.3 The User shall be obliged not to use automated scripts (programs) to collect information and (or) interact with the Internet service.

5.4 Except for cases established by this User Agreement, as well as the current legislation of the Russian Federation, no materials may be copied (reproduced), processed, distributed, displayed, published, downloaded, transferred, sold or otherwise used in whole or in part without prior permission from Mail.Ru, or the respective copyright holder, unless the copyright holder has expressly agreed to the free use of the material.

5.5 The User shall have the right to place through the Services of Mail.Ru the objects of intellectual property, the right to use of which belongs to the User.

5.6 Any use of the Services of Mail.Ru, except as permitted by this User Agreement or in the case of the express consent of the originator (Copyright holder) for such use, without the prior written permission of the Copyright holder, shall be strictly prohibited.

5.7 In case of receipt from the relevant copyright holder of a reasoned complaint of violation of its rights protected by law, Mail.Ru shall have the right to delete the content posted by the User or block access to it by the Users without notifying the User and without giving reasons.

5.8 The User agrees that he/she is personally responsible for any materials or other information that he/she downloads or otherwise makes public (publishes) within the framework of the Services of Mail.Ru or with their help. The User may not download, transfer or publish materials on the Services of Mail.Ru, if they were not created by the User personally or for which the User shall not have permission from the respective copyright holder.

5.9 In case of a complaint from third parties associated with the placement of materials by the User, the User independently and at his/her own cost shall settle such complaints.

5.10. Mail.Ru shall have the right to make copies of materials in order to regulate and facilitate the publication and storage of User Content on the Website.

5.11 The User agrees that he/she is personally responsible for any information and for any materials that he/she places in the Services of Mail.Ru, and for his/her (User) interaction with other Users.

5.12 Due to the fact that the Internet service is open for general access and is not pre-moderated information resource, Mail.Ru shall not be responsible for any materials posted by the Users.

5.13 Mail.Ru shall not be responsible for any conduct of Users using the Services of Mail.Ru, both “online” and “offline”.

5.14 Mail.Ru is entitled, upon the first request of the relevant authorized law enforcement and other authorized state body, but in accordance with the current legislation, to transfer such information to the state body about the User.

6. Non-commercial use

The User agrees not to reproduce, repeat or copy, sell or resell, and not to use for any commercial purposes any intellectual property objects placed in the Mail of Mail.Ru and in other Services of Mail.Ru, except when such permission is given to the User by Mail.Ru.

7. General Provisions on the Use and Storage of Information and Materials

7.1 The User acknowledges that Mail.Ru may impose restrictions on the use of Services of Mail.Ru and Mail, including: the storage period for email messages and any other materials posted by the User, the maximum number of messages that may be sent or received by one User, the maximum size of the email message or disk space, the maximum number of appeals to the Mail and Services of Mail.Ru for a certain period of time, etc.

7.2 The User shall provide Mail.Ru a non-exclusive license for use, including reproduction, distribution, processing, public display and making available to the public of the materials posted by the User as part of an Internet service for public viewing, as content of Mail.Ru available on the Internet service of Mail.Ru, in order to promote the Internet service and its advertising. The originator of the materials specified in this clause shall reserve all property and personal non-property copyrights, in accordance with the legislation of the Russian Federation and international agreements.

7.3 If the User deletes the materials, the rights referred to in clause 7.2. of this User Agreement will be automatically revoked, however Mail.Ru shall have the right to keep archival copies of the content posted by the Users.

7.4 Mail.Ru shall have the right to prohibit automatic access to the Services of Mail.Ru, as well as to stop receiving any information generated automatically (for example, “Spam”). Mail.Ru, at its discretion, may stop communicating with networks that violate the norms of the current Russian and international law, the terms and conditions of this User Agreement, as well as generally accepted principles of interaction established on the Internet.

7.5 The User, using the functionality of the Services of Mail.Ru, agrees that the User’s information may be transferred to Mail.Ru partners solely for the purpose of ensuring the provision of services ordered by the User, as well as providing the Users with the right to use additional functional (software) features of the Internet service provided together with these partners, and only to the extent necessary for the proper provision of these services and the provision of these rights.

7.6 Reproduction, copy, collection, systematization, storage, transfer of information from Services of Mail.Ru for commercial purposes and/or for extraction of a database from Services of Mail.Ru for commercial or non-commercial purposes or using it in full or in any part, shall not be allowed without the consent of Mail.Ru. The use of automated scripts (programs, bots, crawlers) to collect information and (or) interact with Services of Mail.Ru without the consent of Mail.Ru shall be prohibited.

8. Termination of the User Account, as well as Removal of Materials Posted by the User

8.1 The User agrees that Mail.Ru reserves the right to terminate the User’s account at any time without prior notice to the User.

8.2 The termination of the account may be made due to the following reasons:

а) violation of the provisions of this User Agreement and/or the User Agreement of the Service of Mail.Ru, its parts, as well as supplements thereto, which are an integral part of thereof; 

b) upon request of the authorities, in accordance with the legislation of the Russian Federation;

c) extended period of non-use of the account to access Mail.Ru (as defined by this User Agreement);

d) due to unforeseen technical problems or security circumstances;

e) due to interference and any violations in relation to Services of Mail.Ru, including the use of any devices, software, etc.

8.3 Mail.Ru shall reserve the right, at its sole discretion, to modify (moderate) or delete any information published by the User, including information (materials) that violates (violate) the prohibitions set forth in Section 5 of this User Agreement (as well as any other prohibitions and requirements, contained in the current legislation of the Russian Federation), including personal messages and comments, to suspend, restrict or terminate access to any Services of Mail.Ru at any time for any reason or without reasons, with or without prior notice, without being responsible for any harm that may be caused to the User by such action.

8.4 Mail.Ru shall have the right to delete the account of the User and (or) to suspend, restrict or terminate access to any of the services of the Website, if Mail.Ru finds in the User’s actions signs of violation of the terms and conditions of this User Agreement without explanation of the reasons for such actions. Mail.Ru shall reserve the right to remove any materials posted by the User within the framework of the Services of Mail.Ru without explanation of the reasons and without prior notice to the User, however Mail.Ru will make every possible effort to avoid such situations.

8.5 The User agrees that Mail.Ru reserves the right to terminate the maintenance of the User’s account in any Services of Mail.Ru that has not been used by the User for a period of more than six (6) months.

8.6 Termination of the User account shall imply:

a) the removal of the User’s access to the personal part of all Services of Mail.Ru; 

b) the release of the User’s mail box from letters, files and removal of personal settings.

8.7 The User shall have the right to refuse to use its account in the Mail and other Services of Mail.Ru, using the special interface for deleting the account. The correspondence contained in the Mail and the materials placed in the Services of Mail.Ru shall be destroyed without the possibility of recovery. In case of deleting the account at the initiative of the User, the latter shall have the right to restore the account on its own, following the instructions of the Service received after entering the latter in the authorization form in the Mail, used before deleting the account, login and password.

9. Obtaining Rights of Mail.Ru to Intellectual Property

9.1 The User acknowledges and agrees that Services of Mail.Ru contain audiovisual works, computer programs, trademarks and other intellectual property objects, the rights to which belong to Mail.Ru (and/or counterparties of Mail.Ru) and cannot be used without prior consent from Mail.Ru.

9.2 The User shall not reproduce, copy, modify, sell, make public, distribute the content and programs of the Internet service, in whole or in parts, except as otherwise provided in the User Agreement or the terms and conditions of use of any Service of Mail.Ru.

9.3 Mail.Ru shall grant the User a non-exclusive and non-transferable to third parties right to use the software provided within the framework of the Services of Mail.Ru on one computer, provided that neither the User nor any other persons with the assistance of the User will copy or modify this software; create programs derived from the software; enter the software in order to obtain program codes; sell, assign, lease, transfer to third parties in any other form the rights with respect to the Mail software provided to the User under the User Agreement, and modify the Mail, including with the purpose of obtaining unauthorized access to it.

10. Trademark

is a registered trademark, the copyright holder of which is Mail.Ru LLC. Any use on the Internet of the specified trademark shall be allowed only with the consent of Mail.Ru LLC, and in the presence of the obligatory hyperlink from the logo to the website www.mail.ru.

The use of the trademark (logo) image of Mail.Ru or logos of web services of Mail.Ru projects by any means, including placement without approval in print and other media, shall be considered as a violation of trademark rights.

11. Liability of Mail.Ru

The User understands and agrees that:

11.1 The User shall use the Services of Mail.Ru, including Mail, “as is”. Mail.Ru shall not assume any responsibility, including for the compliance of the Services of Mail.Ru with the purposes of the User;

11.2 Mail.Ru shall not guarantee that Services of Mail.Ru will meet the requirements of the User; will be provided continuously, quickly, reliably and without errors; the results that may be obtained by the User will be accurate and reliable; the quality of any product, information and other things obtained using Services of Mail.Ru, including Mail, will meet the expectations of the User, and that all errors in the programs will be corrected;

11.3 Any materials (intellectual property objects) received by the User using the Mail and other Services of Mail.Ru, the User may use at its own risk, and the User shall be liable for any damage that may be caused to the User’s computer and User’s data in the result of downloading these materials;

11.4 Mail.Ru shall not be responsible for any direct or indirect damages resulting from the use or inability to use the Services of Mail.Ru, including Mail; due to unauthorized access to User’s communications; due to fraudulent activities of third parties, including the use of the designation or the Mail.Ru trademark for personal gain.

11.5 Mail.Ru shall not be responsible for the use of the User of the electronic mail box for commercial purposes, including the storage of documents and business correspondence.

12. Confidentiality of Mail.Ru

12.1 Mail.Ru may use the User identification technologies, including using cookies, as well as use these technologies for marketing purposes to study the preferences of the Users. In this case, such identification is non-personalized and generalized, Mail.Ru shall not track the actions of individual Users and shall not transmit information about them. However, this information may be provided to authorized state bodies in accordance with the current legislation of the Russian Federation.

12.2 Within the limits of the functioning of Services of Mail.Ru, the privacy of messages shall be ensured and the confidentiality of information about Mail.Ru Users shall be maintained, except in cases provided for by the legislation of the Russian Federation.

12.3 There is no censorship in the Services of Mail.Ru. The User agrees that its outcoming and incoming messages in the Mail pass through certain automatic processing by Mail.Ru programs in order to fully send, receive and store messages in the Mail. Mandatory automatic processing of Mail includes the necessary set of measures to detect malicious codes in the transmitted information, and, if possible, block or delete them (depending on the complexity of this code and the software of Services of Mail.Ru). These measures shall be taken only to protect the personal computers of the Users, as well as to reduce the load on the Mail.Ru equipment.

12.4 The User shall consent to the use of registration data by Mail.Ru in a generalized form, with a view to “targeting” on the Services of Mail.Ru, while the addresses of the Mail of the Users will not be passed on to third parties.

13. Principle of Respect for the Rights of Internet Users

The Users of the Services of Mail.Ru undertake to respect the rights of each other and third parties, shall observe established traditions and ethics on the Internet, and shall not abuse the capabilities of the Services of Mail.Ru in order to contradict the norms of current legislation, as well as morality.

14. Information security

14.1 The User shall not have the right to access any other information of the Services of Mail.Ru, in addition to the User’s own information in its mail box, as well as to information that is publicly available in the Services of Mail.Ru.

14.2 Upon detection of the person performing the action qualified as spam in the Mail of Mail.Ru, Mail.Ru shall have the right to block receipt of email messages from the mail address of the specified person (including Users) to the mail addresses of Mail.Ru.

14.3 Mail.Ru shall not be responsible for the safety of the account name of Mail.Ru and password of the User, if such a User uses the forms located on external Internet sites to access the Mail.

15. Internet service interruptions

15.1. Mail.Ru shall have the right to perform maintenance work in the Services of Mail.Ru with the temporary suspension of the Services of Mail.Ru.

15.2. In the case of force-majeure circumstances, as well as accidents or failures in software and hardware complexes of third parties cooperating with Mail.Ru, or actions of third parties aimed at stopping or terminating the operation of all or part of Services of Mail.Ru, it is possible to suspend the work of the Services of Mail.Ru without prior notice to Users.

16. Feedback and Claims Review Procedure

A User, who believes that his/her rights and interests have been violated because of actions of Mail.Ru, may send an appropriate appeal. Appeals shall be handled by the Mail.Ru User Support Service in accordance with the general procedure for processing incoming requests.

All appeals, including those regarding the performance of the Services of Mail.Ru, the User can send to the User Support Service via the form https://help.mail.ru/mail-help/.

The User and Mail.Ru agree that all possible disputes over the User Agreement will be resolved in accordance with the rules of the current legislation of the Russian Federation.

17. General information

17.1. Nothing in the User Agreement can be understood as the establishment of agency between the User and Mail.Ru, partnership relations, joint activity relations, personal employment relations, or some other relationship not expressly provided for by the UA.

17.2. The recognition by the court of any provision of the UA as invalid, or not subject to compulsory execution, shall not entail the invalidity or unenforceability of other provisions of the UA.

17.3. Inaction of Mail.Ru, in the event of a violation by the User, or other third parties, of the provisions of the UA shall not deprive Mail.Ru of the right to take appropriate actions to protect its interests later.

17.4. All the disputes between the Parties with respect to this agreement shall be settled by communication and negotiations through the pre-trial (complaints) procedure. If the Parties fail to agree by the negotiations within sixty (60) calendar days after receipt of a written claim by the other Party any Party concerned shall submit the dispute to the court local to Mail.Ru (excluding the jurisdiction of other courts over the dispute). 

18. Amendments and Supplements to the UA

18.1. This User Agreement and agreements for individual Services may be modified by Mail.Ru without any prior notice. Any amendments to the User Agreement made by Mail.Ru unilaterally shall become effective from the day following the date of publication of such amendments on the Internet service/pages of the corresponding Service of Mail.Ru. The User shall independently verify the User Agreement and the terms and conditions of the agreements for individual Services of Mail.Ru for any amendments made. The User’s failure to read shall not give rise to the User’s failure to perform his/her obligations and observe the limitations stipulated by this User Agreement and agreements for individual Services of Mail.Ru.

18.2. In the case of the adoption of regulatory acts by the authorities of the Russian Federation, affecting in whole or in part the functioning of Mail.Ru and Services of Mail.Ru, Mail.Ru shall also reserve the right to make any changes in the functioning of Services of Mail.Ru aimed at bringing Mail.Ru activities in accordance with the new norms.

18.3. The User may refuse to accept amendments and modifications to this User Agreement and/or individual Services of Mail.Ru, which means the User’s refusal to use the Internet service and/or any individual Services of Mail.Ru and waiver of all rights previously granted to him/her.

The use of any Service of Mail.Ru means the unconditional consent of the User with the provisions of this User Agreement.
